Facebook कमेंट पर बिना इजाजत गिरफ्तारी नहीं: सुप्रीम कोर्ट

सुप्रीम कोर्ट ने गुरुवार को कहा कि सोशल नेटवर्किंग वेबसाइटों पर आपत्तिजनक टिप्पणी करने के मामले में किसी भी व्यक्ति को वरिष्ठ पुलिस अधिकारियों की पूर्व अनुमति के बिना गिरफ्तार नहीं किया जाना चाहिए.

वेबसाइटों पर आपत्तिजनक टिप्पणी करने वाले किसी व्यक्ति की गिरफ्तारी पर पूरी तरह रोक लगाने का आदेश जारी करने से इनकार करते हुए शीर्ष अदालत ने कहा कि राज्य सरकारों को केंद्र के 9 जनवरी के परामर्श का सख्ती से पालन करना चाहिए, जिसमें कहा गया है कि वरिष्ठ पुलिस अधिकारियों की अनुमति के बिना किसी को गिरफ्तार नहीं करना चाहिए.

न्यायमूर्ति बीएस चौहान और न्यायमूर्ति दीपक मिश्रा की पीठ ने कहा, ‘हम राज्य सरकारों को निर्देश देते हैं कि किसी भी गिरफ्तारी से पहले दिशा-निर्देशों (केंद्र द्वारा जारी) का पालन सुनिश्चित करें.’ पीठ ने कहा कि अदालत इस तरह के मामलों में गिरफ्तारियों पर पाबंदी का आदेश जारी नहीं कर सकती क्योंकि सूचना प्रौद्योगिकी अधिनियम की धारा 66ए (आपत्तिजनक टिप्पणियों से संबंधित) के लागू होने पर शीर्ष अदालत ने रोक नहीं लगाई है जो इसकी संवैधानिक वैधता की पड़ताल कर रही है.

फेसबुक पर टिप्पणियां करने या टिप्पणियों को ‘लाइक’ करने के मामले में लोगों की गिरफ्तारी को लेकर जनता की नाराजगी के मद्देनजर केंद्र सरकार ने 9 जनवरी को सभी राज्यों को परामर्श जारी कर कहा था कि इस तरह के मामलों में बिना किसी वरिष्ठ पुलिस अधिकारी की मंजूरी के किसी को गिरफ्तार नहीं किया जाए.

शीर्ष अदालत ने एक आवेदन पर सुनवाई की जिसमें अधिकारियों को यह निर्देश देने की मांग की गयी है कि सूचना प्रौद्योगिकी अधिनियम की धारा 66ए की संवैधानिक वैधता से जुड़ा मामला अदालत के समक्ष लंबित होने के दौरान वेबसाइटों पर आपत्तिजनक टिप्पणियां डालने पर कोई कार्रवाई नहीं की जाए. धारा में प्रावधान है कि कोई व्यक्ति यदि किसी कंप्यूटर उपकरण या संचार उपकरण से इस तरह की कोई जानकारी भेजता है जो पूरी तरह अप्रिय है और जिसका स्वभाव डराने वाला है तो उस व्यक्ति को अधिकतम तीन साल की कैद की सजा सुनाई जा सकती है और जुर्माना भी लगाया जा सकता है.

हैदराबाद की एक महिला कार्यकर्ता की गिरफ्तारी के संबंध में भी याचिका दाखिल की गयी थी जिसे तमिलनाडु के राज्यपाल के रोसैया और कांग्रेस विधायक अमानची कृष्ण मोहन के खिलाफ फेसबुक पर कुछ ‘आपत्तिजनक’ टिप्पणियों को लेकर जेल भेज दिया गया था. याचिका दाखिल करने के बाद उसे हैदराबाद की एक जिला अदालत ने रिहा कर दिया. पीपुल्स यूनियन फॉर सिविल लिबर्टीज (पीयूसीएल) की प्रदेश महासचिव जया विंधायल को आपत्तिजनक पोस्ट के मामले में सूचना प्रौद्योगिकी कानून की धारा 66ए के तहत 12 मई को गिरफ्तार किया गया था. पुलिस के मुताबिक महिला कार्यकर्ता ने ऑनलाइन टिप्पणी करने से पहले रोसैया और मोहन के खिलाफ कथित तौर पर पर्चे भी बांटे थे जिनमें आपत्तिजनक आरोप थे.

कानून की विद्यार्थी श्रेया सिंघल ने पीठ के समक्ष मामले को रखते हुए तत्काल सुनवाई की मांग की थी और कहा था कि धारा 66 ए की वैधता को चुनौती देने वाली जनहित याचिका शीर्ष अदालत के समक्ष लंबित है और उसके बाद भी पुलिस ऐसे मामलों में कार्रवाई कर रही है.

A Short Story

एक कुत्ता जंगल में भटक गया,
तभी उसने देखा एक शेर उसकी तरफ आ रहा है,
कुत्ते की सांस रुक गयी सोचा आज तो काम तमाम हो गया मेरा!
उसने कुछ देर तक सोचा-फिर अपने सामने कुछ हड्डियाँ पड़ी हुई देखी!
वो आते हुए शेर की तरफ पीठ करके बैठ गया,और एक सुखी हड्डी
को चबाने लग गया,और जोर-जोर से चिल्लाने लग गया,
शेर खाने का तो मज़ा ही कुछ और है!
एक और मिल जाये तो लंच और डिनर दोनों एक साथ हो जायेंगे।
इस सीन को देखकर शेर सकते में आ गया,उसने सोचा ये कुत्ता
तो शेरो को खाता है,जान बचाओ और भागो यहाँ से,
और शेर वहाँ से चम्पत हो गया!
पास के पेड़ पर बैठा एक बन्दर सारा तमाशा देखकर रहा था,
उसने सोचा मौका अच्छा है शेर को सारी कहानी बता देता हूँ शेर से दोस्ती हो जाएगी और जंगल पर अपना ही राज चलेगा,वो फटाफट शेर के पीछे भागा,
कुत्ते ने बन्दर को जाते हुए देख लिया और वो समझ गया की कोई न कोई लोचा जरुर है,उधर बन्दर ने शेर को सारी कहानी समझा दी-की आप तो जंगल के महाबली राजा हो उस कुत्ते ने आपको बेवकूफ बना दिया
शेर जोर से दहाड़ा-चल अभी कुत्ते की जीवन लीला समाप्त कर देते है
शेर ने बन्दर को अपनी पीठ पर बिठाया और कुत्ते की तरफ दौड़ा,
कुत्ते ने फिर अपना दिमाग लगाया,और फिर शेर की तरफ पीठ करके जोर -जोर से बोलने लगा
साले बन्दर को भेजे एक घन्टा हो गया एक शेर को फँसाकर अभी तक भी वापस नहीं लौटा,और शेर ने बन्दर की जीवन लीला समाप्त कर दी


The moral of the story is , 

1)  Joo logoo ki Batoo par vishwas karta hai, apni Akkal or Demag ka istimal nahi karta. Voo lion ho kar bhi Kutta sa Darta Ha. Or Apna hi Nuksan karlata haa.

2) Agar Dimag ka istimal hoo sahi too, Lion ko bhi Bevakoof Bana sakta ha.
